1. Acceptance of Terms

Welcome to Speaklyn. By accessing or using our AI-powered conversational coaching application ("Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the Service.

Speaklyn is a proprietary product owned and operated by Lakshya Gupta. These Terms constitute a legally binding agreement between you and Speaklyn.

2. Description of Service

Speaklyn is an AI-powered conversational application designed to help users improve their communication skills. The Service provides:

• Interactive AI conversations across various topics
• Real-time vocal tone and speech pattern analysis
• Emotional intelligence detection (including arrogance, politeness, humility, warmth, and tension)
• Personalized coaching reports and feedback
• Progress tracking and improvement recommendations
• Audio analysis of conversation texture and style

3. User Accounts and Eligibility

To use Speaklyn, you must:

• Be at least 13 years of age (or the age of majority in your jurisdiction)
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account

You agree to notify us immediately of any unauthorized use of your account.

4. Subscription Plans and Payments

Speaklyn offers both free and paid subscription plans:

• Starter Plan: Free tier with limited conversations and basic features
• Pro Plan: Paid subscription with unlimited conversations and advanced features

By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis. Subscriptions automatically renew unless cancelled before the renewal date. Refunds are provided at our discretion and in accordance with applicable law.

5. Audio Recording and Analysis

By using Speaklyn, you explicitly consent to:

• Recording of your voice during conversations with the AI
• Analysis of your vocal tone, speech patterns, and emotional expression
• Processing of audio data to generate coaching reports and feedback
• Storage of conversation data for personalized coaching improvements

All audio recordings and analysis are conducted solely for the purpose of providing and improving the Service. We do not share your audio recordings with third parties except as described in our Privacy Policy.

6. Acceptable Use

You agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to reverse engineer, decompile, or extract the source code of the Service
• Interfere with or disrupt the Service or servers
• Upload malicious code, viruses, or harmful content
• Impersonate others or provide false information
• Harass, abuse, or harm other users
• Use the Service to collect data about other users
• Circumvent any access restrictions or usage limits

7. Intellectual Property Rights

Speaklyn is a proprietary product. All rights, title, and interest in and to the Service, including all software, algorithms, AI models, designs, text, graphics, and other content, are owned exclusively by Lakshya Gupta and protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or lease any part of the Service.

8. User Content and Data

You retain ownership of your conversation data and audio recordings. By using the Service, you grant Speaklyn a worldwide, royalty-free license to:

• Process and analyze your audio and conversation data
• Generate coaching reports and personalized feedback
• Improve our AI models and Service quality (using anonymized data)

You may request deletion of your data at any time by contacting us at lakshya.gupta.ug24@plaksha.edu.in.

9. Disclaimers and Limitations

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. SPEAKLYN DOES NOT GUARANTEE:

• Uninterrupted or error-free operation
• Accuracy of AI analysis or coaching recommendations
• Specific results or improvements in communication skills
• Compatibility with all devices or operating systems

Speaklyn is a coaching tool and should not be considered a substitute for professional therapy, medical advice, or psychological counseling.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPEAKLYN AND ITS OWNER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR PROFITS, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PAST 12 MONTHS.

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of subscription fees
• Any reason at our sole discretion

You may cancel your subscription at any time through your account settings.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes shall be resolved in the courts of competent jurisdiction in India.
